In the state of Florida, DUI is defined as driving with a Blood Alcohol Concentration (BAC) of 0.08 or above. However, for those operating commercial vehicles, a BAC of 0.04 or higher is sufficient for a DUI conviction. Drivers under the age of 21 can be charged with driving under the influence if their BAC is 0.02 or higher. In addition to being charged with driving under the influence, drivers may be accused of many related crimes, including refusing to submit to a chemical test, vehicular homicide, or DUI manslaughter.

DUI Penalties

DUI penalties can vary considerably depending on your age, your level of intoxication at the time of arrest, and your criminal history. Additional consequences for first-time offenders include license suspension, fines of up to $500, community service, mandatory participation in education programs, and temporary vehicle impoundment. For second-time offenders, the maximum jail sentence is 270 days and the maximum fine is $1,000. If the second offense occurs within five years of the first offense, the minimum jail sentence is ten days.
